Who should attend this course?
Anyone who is responsible for the payment of fees for professional services and for the operation of Professional Services Withholding Tax (PSWT); the submission of 3rd party Returns to Revenue, or anyone who is responsible for making payments made to members of State of State sponsored Committees or Boards, will find this course to be of immense value.
What does the course cover?
The course outlines the legislation and the rules relating to the operation of PSWT to include amendments to the list of accountable bodies introduced in the Finance Bill 2013. It examines the types of payments which are liable to PSWT and those which are not, and it identifies many "professional services" which are not subject to PSWT. It outlines the rules in relation to Irish and overseas service providers, the forms to be completed and submitted to Revenue, and how arrears and amendments should be dealt with. The course also examines many of the practical difficulties which payers have to deal with, especially those concerning multiple supplies, where only some qualify as professional services. The course covers a whole range of payments and uses many real life scenarios to highlight the complications which can arise and which lead to problems.
The course also outlines the requirements for certain public bodies to file a Return of 3rd Party Payments to Revenue, instead of having to submit an annual PSWT schedule of payments, and what payments must be included in this return.
When a person serving on a State, or State sponsored committee or board, is paid for services supplied, is that payment subject to PAYE, PRSI & USC, or is the individual treated as being self employed and if so, is the payment subject to PSWT? What are the rules for determining the correct tax treatment of such payments?
What is the tax treatment of expenses paid to committee or board members of a non commercial body which they incur when attending committee or board meetings of that body? What are the rules which permit such expenses to be paid free of tax and who qualifies under these rules?
What will Revenue look at in the event of a Revenue audit and what are the possible repercussions? Why do Revenue treat short comings in the payments to members of State and Semi State Committees and Boards in a particularly harsh manner?
