In the current uncertain economic climate, many employers are being forced to change work practices. But what changes can they legally introduce and how are such changes affected by current employment law? These matters will be addressed in detail by a barrister who specialises in the area of Employment Law.


The following topics will be covered on the day:

Changing a Contract of Employment

What changes can an employer introduce to an employee's contracted terms of employment? Changes in hours of employment, days of work, nature of duties and conditions of employment are all being introduced by employers, but how are these changes affected by current Employment Law and if employees object, what can an employer do? An issue of hugh importance to employers today, this will be discussed in great detail with many practical examples and guidance given on how to deal with this contentious topic.


Contracts of Employment - Terms of Employment (Information) Acts 1994 & 2001

The contract of employment is being drafted more precisely now than at any other time in Irish business life. This is partly due to clauses which compensates the employee when the contract is terminated by the employer. Sometimes the presence of a written contract will also hinder a company's ability to restructure e.g. renegotiate new contracts for executives and employees. The issues to consider and the possible problems arising when drafting a contract of employment will be discussed.


Joint Labour Committees (JLCs) and Employment Registered Agreements (ERAs)

JLCs and ERAs are the subject of much disquiet within many industries as they impose a set rate of pay on many employers in various industry sectors. What are JLCs and ERAs? Who is affected by them and what are the provisions that an employer can use to counter the restrictive and the anti competitive ERAs? All of these will be discussed.


Holidays and Public Holidays - Organisation of Working Time Acts 1996 - 2001

After the many cut backs introduced into the business sector, employee's annual holiday and Public Holiday entitlements are a topic of heated debate, due to reductions in the hours worked. In many cases, there will not be a reduction in the annual holidays and Public Holiday entitlements for job sharers, part-time, short term and fixed term contract employees and those on reduced hours. These matters will be discussed in detail.


Redundancies - Redundancy Payments Act 1967 - 2007

Changing work practices can also mean making redundancies. The rules for making, redundancies and redundancy payments, which are enforced by various Tribunals, NERA and other bodies, will be covered and discussed. However, the State is also found wanting in its handling of redundancy rebates to employers. A discussion on the current case law and efforts to have rebates paid or offset against PAYE/PRSI liabilities will be discussed.


Minimum Wage - National Minimum Wage Act 2000

The rules on the National Minimum Wage and employers inability to pay will be discussed. If the National Minimum Wage is reduced, will a reduction apply to current employees, or only new employees? We will look at the relevant legislation that provides for situations when it is ok to pay less than the minimum wage and a review of the mechanism of how to do this will wrap up this topic.

This dynamic course is being delivered by Employment Law specialist Derek Ryan BL. Derek is a barrister who has extensive practical experience in employment law matters. He has represented numerous people and organisations at hearings of the Rights Commissioners and the Employment Appeals Tribunal. Derek is the Senior Law Lecturer of IPASS and is the legal editor of the IPASS book.
